Luigi Mangione: The Official Criminal Complaints Filed Against Him
Full Texts of Federal Complaint + NY & PA State Complaints
I’m officially “all in” on documenting and reporting on this case, as I find the way in which it is being covered by both mainstream media and “independent journalists” to be…perplexing, to say the least. However I will save such speculation for a future piece, the purpose of this first article is simply to provide the full text of the federal and NY state criminal complaints that have been filed and unsealed against Luigi Mangione—and maybe point out a few items of interest. I am me, after all, someone notoriously unable to “stfu.”
“Legal Deep Dives” further explaining each complaint, the charges, and the sentencing implications will follow shortly—along with my own commentary and theories. This is about to become the Unofficial Headquarters for All Things Luigi Mangione, so buckle up for the ride!
The Federal Criminal Complaint has four counts, while the New York State Criminal Complaint has eleven counts. Notably, the terrorism charge comes from New York State, not the Department of Justice. The Federal Complaint is, in my humble opinion, much more interesting to read, and critical for understanding the “official” order of events, as well as for seeing the photographs included. We all saw the pictures circulating in the media and hear the wild reports, but it is helpful to see what the Department of Justice itself is saying, along with the evidence they are citing in the official filings. We will come back to this official timeline and the photos a lot in future analysis and commentary. The NY State Complaint is just a list of counts, it isn’t a full-blown timeline of events and contains no evidence or statement of facts that illuminates much on the story. It will likely be amended in the future, but I’ve provided it as it appeared when it was filed.
The full text of the Federal Criminal Complaint is below1, the four counts contained within it are: 1) Stalking—Travel in Interstate Commerced, 2) Stalking—Use of Interstate Facilities, 3) Murder Through Use of a Firearm, 4) Firearms Offense—Firearm equipped with a silencer or muffler.
And here is the NY State Criminal Complaint2:
The PA Complaint & Thomas Dickey’s Pre-Trial Motion for Relief
I’m including the original PA complaint as well as Thomas Dickey’s supplemental motion for relief, which was his set of documents he filed in order to suppress evidence. I’m adding this in because the original PA complaint is very difficult to read for lay people or to identify where the actual charges are, its not the same type of fully written complaint as is used in NY. It’s a form that gets filled out, and the charges are much clearer in Dickey’s supplemental motion, which can be found listed out at paragraph 4.
And here are just the first two pages of Dickey’s supplemental motion, paragraph 4 on page 2 is a clear description of each charge:
Alright, let’s all rest our eyes and put our thinking caps on to mull these complaints over in our heads. Think about what you remember about the live coverage as it was happening, the discussions you remember being a part of and observing, and the questions being asked. What theories were being set forward about motive, and by whom? What pieces of information didn’t make sense? Does anything in either of the above complaints bring clarity to anything, or raise more questions?
All I’ll say for now is that it’s striking to me that the photos in the complaint are the exact same ones that were being released to the press in real-time, without a single different or additional one. Yet, there is a claim that there are over 2 terabytes of evidence against Mangione that have not yet been turned over to his attorneys. I’ll be covering that in another article soon, too, but many of the most critical questions I have as an attorney revolve around this supposed 2 terabytes of digital evidence contained on a drive that federal agents have not turned over or used in their criminal complaint.
As of writing, Mangione’s next state hearing is set for February 21, 2025. This is the only future hearing date I’ve been able to confirm is correct with the Court so far; The NY Post reported that his next Federal hearing was set for January 18th3, however that is a Saturday and it would be very unusual. I’m not saying it’s impossible, my husband has had one or two hearings for very specific types of immigration matters scheduled on a Saturday over the course of ten years in practice, so I know it’s theoretically possible to hold one on a Saturday if there’s some kind of legal reason. However, my feeling is that this was a typo or error that multiple other sources picked up from the original NY Post piece. I am working on confirming the date for the next federal hearing, and will post it here when I do.
I will be traveling to NYC to cover the February 21st hearing in person, and am hoping to do the same for the next federal hearing, whenever it turns out to be, which should be possible as long as it doesn’t conflict with any of my hearings in LA.
